Holder and general conditions of contract

These General Conditions of Contract, from now on CGC, regulate the conditions of purchase of the different products offered on our website: www.pinturas-dami.com, owned by BRICO-PINTURAS DAMI VENTA ONLINE S.L.U. (hereinafter BRICO-PINTURAS DAMI ), Spanish company, with CIF B42693440, and located in C / Argel, 3 - 03130 Santa Pola (Alicante) - Spain.

Users who make purchases at www.pinturas-dami.com fully accept these GTC and will be bound by these, as if they were written at the time of contract / purchase.

Reading and acceptance of the CGC will be a prerequisite, prior to the purchase of any product through www.pinturas-dami.com

According to current legislation, you can proceed to the return of products, for whatever reason, within a maximum period of 14 calendar days from the receipt of the goods by the clientand. For this, the conditions set forth in this document must be met. You can do it by filling in the withdrawal form.

BRICO-PINTURAS DAMI reserves the right to modify the CGC at any time and without prior notice. The CGC will always be accessible from the website, so that the user can consult or print them at any time.

The completion of the order by completing the purchase form, implies compliance with the price offered and the general conditions of sale in force at that particular moment. Once the order is formalized, the purchase will be deemed perfected as of right, with all the legal guarantees that protect the acquiring consumer and, from that moment, the prices and conditions will be contractual and can not be modified without the express agreement of both contracting parties . The electronic document in which the contract is formalized will be archived and the user will have access to it in his client area.

Shipping terms

  • Delivery times range between 24 and 72 hours at the customer's choice. We can not guarantee these delivery times, although we try to ensure that the transport companies always comply with them.before it is possible. In rural populations far from urban centers it is not possible to guarantee delivery in 24 hours.
  • It is not possible to determine a fixed delivery schedule and make a prediction of the exact time at which the delivery person will deliver the order.
  • The shipment is guaranteed under the conditions chosen by the customer in the order formalization, provided that it is made before 16 hours and the product is in stock. After this time, one more day will be counted since the transport agency will have already collected the packages of that day.
  • Delivery times will depend on the availability of each product, being the case of breakages of stock in storage in which case the customer will be notified with the new delivery time. In the orders that include several articles a single shipment will be made and the delivery time will correspond to the item whose delivery time is greater.
  • The customer should review the order as soon as possible to verify that everything that has been requested is included. If you are not happy with what you have received, you must notify BRICO-PINTURAS DAMI as soon as possible. An order will be considered delivered when the delivery receipt is signed by the customer.
  • If for any reason there was a delay in the shipment we would inform you of the delivery time that will not be longer than 10 days. If you do not agree with the new delivery time, you can request the refund of the full amount paid withoutno type of penalty.
  • If there is a fault in the order, BRICO-PINTURAS DAMI will be immediately notified by email info@pinturas-dami.com attaching photos if possible and description of the problem. BRICO-BRICO-PINTURAS DAMI will try to correct this error as soon as possible.
  • In case of receiving a product damaged by transport, it is advisable to contact us within the first 24 hours in order to claim the incident from the transport company. In the same way it is convenient to leave a record to the transport company. If you notice large defects in the package when it is delivered or paint stains, it is advisable not to accept the package and communicate this decision as soon as possible so that you can send your order and it arrives in perfect condition as soon as possible. If those damages see them when the deliveryman has already left, you must send us photos of the package closed with the damages in the following 24 hours in order to be able to claim the damages to the transport agency and be able to send you your order again.
  • The shipping costs are easily calculable, there is no more to add the products to the cart and to put the delivery address, you can choose between several shipping methods depending on province or even country. The shipping costs are based on the total weight of the cart and the place of destination.
  • LShipping costs will be free from € 90 of order (tax)included) without counting the postage. This condition will only be applicable to any destination that is within Peninsular Spain. For the rest of destinations, the shipping costs will always be applicable except agreement between the parties.

Sale in the Canary Islands, Ceuta and Melilla

All sales made in the Canary Islands, Ceuta and Melilla are considered exports, so when a client of these destinations completes his file and adds his address, the VAT of all the products will be automatically eliminated.

Currently of these three destinations we only ship to the Canary Islands for logistical reasons, and the price of the port will depend on the island of destination. The shipment will be made by boat because there are many products that, due to their dangerous condition, can not travel by plane and will take between 10 and 15 calendar days. Shipments will be made in condition "T2LF Expedition without DUA export" provided that it meets the conditions, but upon arrival, the client assumes the additional costs that can be charged in customs such as the import DUA or the Canary Islands tax (IGIG) ).

The destinations to Ceuta and Melilla are not yet possible, but we are working so that we can send to these destinations shortly.

Shipping methods

The shipment of our merchandise is carried out through several urgent and non-urgent transport agencies or through ADR transport for some of our products. BRICO-PINTURAS DAMI reserves the right to modify the type of shipment as long as the product can not be shipped by the agency indicated either by dangerous conditions or by size or weight. BRICO-PINTURAS DAMI will communicate this decision, if it occurs, to the client by email. Below we show the most common shipments and agencies used by BRICO-PINTURAS DAMI, but these may vary depending on the existing offer in the market.


  • TIPSA72: Delivery service in 48/72 hours according to destination. In some cases of large cities or provincial capitals delivery is made even in 24 hours.
  • CORREOS PAQ72 DOMICILIO: Delivery service in 48/72 hours at home according to destination through the public company Correos.
  • CORRESO PAQ72 OFFICE: Delivery service in 48/72 hours at the post office closest to the address provided by the customer.
  • TIPSA24: Delivery service in 24 hours. Delivery is guaranteed before 2pm the following day provided the order is confirmed before 4pm.
  • Large Weights and ADR: Entrega in 48/72 hours according to destination through the agencies Dachser or DB Schenker according to the case. It includes the use of dangerous goods with ADR category that can not travel by more urgent methods.


  • TIPSA72: Delivery service in 48/72 hours according to destination. In some cases of large cities or provincial capitals delivery is made even in 24 hours.
  • CORREOS PAQ72 DOMICILIO: Delivery service in 48/72 hours at home according to destination through the public company Correos.
  • CORRESO PAQ72 OFFICE: Delivery service in 48/72 hours at the post office closest to the address provided by the customer.
  • Large Pesos and ADR: Delivery in 72/96 hours according to destination. It includes the use of dangerous goods with ADR category that can not travel by more urgent methods.


Currently we only send to the Canary Islands. The transport is done by boat. As soon as you register your address in the Canary Islands, VAT no longer applies to prices.

  • Canary Islands: Delivery between 10 and 12 days from the completion of the order.


All shipments to any country in Europe that are in the address list, will be made through the company GLS and the transit time will be between 4 and 7 business days from the date of placing the order.


You have 14 days to return a product since you receive it at your home. To do this, send an email to info@pinturas-dami.com with information regarding the order indicating the products you want to return and the reason. Once we receive the product / s, we will refund your money according to the payment method you used:

  • If you paid with card, the payment will be made in your account within 48 to 72 hours.
  • If you paid for Paypal, the payment will be made in your Paypal account.
  • If the payment was made by transfer, we will ask you for an account number to make the payment. Keep in mind that it can take up to 48 working hours until it is reflected in your bank account.

You will only be responsible for the disvalue reduction of the goods resulting from a manipulation of the same, different from that necessary to establish its nature, characteristics or operation.

Below are the rights and obligations of both the seller and the consumer with respect to the guarantee:

  • In case of defective product, the seller must proceed, as appropriate, to the repair, replacement, price reduction or termination of the contract, steps that will be free for the consumer and user.
  • The seller is responsible for the lack of conformity that manifests itself within two years of delivery.
  • The consumer and user must inform the seller of the lack of conformity within two months of having knowledge of it.

  • Damage caused by paints or other products in areas or places where they should not be applied caused by lack of knowledge of the customer. Whenever there are doubts, the consultation should be made before applying on a surface that could be damaged.

For these purposes, BRICO-PINTURAS DAMI informs that the Consolidated Text of the General Law for the Defense of Consumers and Users (TRLGDCU) establishes several options to exercise the right of withdrawal. Cancellation of orders

Those cancellations of orders that imply a return to the client and that are por bank transfer will have a maximum period of 30 days for administrative procedures, although we try that the term does not exceed 7 days.

Litigation resolution

These general conditions are ruled by the Spanish Law. The parties submit, at their option, for the resolution of conflicts and renouncing any other jurisdiction, to the courts and tribunals of the user's domicile. Likewise, as an entity adhering to CONFIANZA ONLINE and in the terms of its Code of Ethics, in case of disputes related to online contracting and advertising, data protection and protection of minors, the user may resort to the dispute resolution system of CONFIDENCE ONLINE (www.confianzaonline.es).
